This portion of our response was delayed <br />due to holiday vacation schedules of staff, as discussed with <br />Thomas Ehmett of your office on December 24. We appreciate your <br />acknowledgement of our request for time to respond. <br />Item 2 of TDN X=92-020-370 TV-2 was issued for an alleged violation <br />of Rules 4.13 and 4.10.4(5) for failure to contemporaneously <br />reclaim the Cameo Refuse Disposal Areas (CRDA's) 1 and 2 at the <br />Roadside and Cameo Mine. Table 2.05.4A in the Roadside permit <br />contains a reclamation timetable which indicates timeframes for <br />reclamation of the refuse disposal areas at the mine. This table <br />and page 186 of the permit indicate that revegetation of the refuse <br />areas will begin in year two following completion of the piles, <br />assuming there are no active seeps on the faces of the piles. <br />When construction and reclamation of these refuse piles. was <br />permitted, the question of cover depth requirements not resolved. <br />The operator established field trials as discussed in Rule 4.15.6 <br />on the Roadside refuse area in an effort to determine minimum cover <br />depth requirements for the refuse areas. These field trials were <br />initiated in 1983 and were originally intended to be studied for <br />five years. <br /> <br />
