b ~ <br />III 01001~01~~0~~~I0 <br />999 <br />Board -May 23, 1984 <br />Albert Frei <br />Walstrum Mine - File No. 83-33 <br />We are here today to consider the assessment of civil penalties for Mr. Frei's <br />violation of conducting mining operations outside of the Walstrum Mine's <br />permitted area. <br />As background, the Walstrum Mine is located north of Highway 6 in Clear Creek <br />County where Highway 6 intersects I-70. At last month's Board meeting a <br />notice of violation was issued to Mr. Albert Frei for activities at the <br />Walstrum Mine. The unpermitted activies included two fill operations beside <br />Clear Creek which were being used as stockpile areas, employee parking areas, <br />and a truck scale and turn-a-round. The Board found Albert Frei in violation <br />of mining outside the permit boundary and deferred civil penalty subject to <br />the submission of a technical revision. <br />The technical revision was submitted on May 15, 1984 and will be considered by <br />the Board later in today's meeting. Currently, the Board needs to consider <br />civil penalties for the violation. These operations were first officially <br />noticed during an inspection on April 10, 1984. Activities were continuing in <br />this area when I revisited the site on May 18, 1984. Therefore the duration <br />of the activity at this point has been 38 days. <br />Would the Board like to review slides and the map of the areas in question? <br />The Board is the one to set civil penalties. However, the law directs that <br />for a 112 permit a civil penalty of not less than one hundred dollars per day <br />nor more than one thousand dollars per day be assessed for each day a <br />violation occurs. <br />~~ ._ ~ ~ ~- DSO ~- w ~' / a y~a~ o-~~ <br />~~~ L~ <br /> <br />
