<br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article33, Section 116, Paragraph 4,
<br />of the Colorado Revised Statutes, that on July 8, 2002, an application to revise coal mining operations at theMunger Canyon
<br />Mine was considered complete for the purposes of filing. The revision was submitted by Lodestaz Energy, Ina All review and
<br />comment periods as provided in the Act and the Regulations initiate from this date of filing.
<br />This revision would allow for construction of a small (4.9 acre) coal mine waste disposal azea, to handle waste material from the
<br />operator's McClane Canyon Mine (Permit No. C-1980-004) located adjacent to the Munger Canyon Permit area. The proposal
<br />includes plans for diversion ditches, a sediment pond, and re-located road segment.
<br />The underground coal mining operation is on land located approximately 18 miles north ofLoma, Colorado. The permit area is
<br />further described as follows:
<br />Mine site: Portions of Sections 21, 27, 28, 29, 32, 33, and 34, T7S, R102W, 6th P.M., all in Garfield County.
<br />Portions of Sections 2 and 3, TSS, R102W, 6th P.M., all in Garfield County. The proposed disturbance associated with this
<br />revision is located within the SWl/4 Sec. 28, T7S, R102W, ti's P.M. (see enclosed location maps).
<br />The revision disturbance area is shown on USGS 7.5 minute Howard Canyon Quadrangle map
<br />The applicant is required [o publish notice in a local newspaper that this application has been deemed complete. At the time of
<br />publication of this notice, the applicant is additionally required to place a copy of this application at the Mesa County
<br />Courthouse, and at the Division office. For additional information or to provide written comments, contact the Division of
<br />Minerals and Geology, Room 215, 1313 Sherman Street, Denver, Colorado 80203, (303) 866-3567. in order for us to comply
<br />with regulatory time frames, we request [hat comments be submitted within fifteen (IS) days of this letter. If no comments are
<br />received by then, we will proceed on the assumption that you have no concerns with, or objections to, the applicant's proposal.
