Walther
Executive Director
Ronald W. Cattany
Acing Division Director
The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116,
Paragraph 4, of the Colorado Revised Statutes, that on July 8, 2002, an application to revise coal mining operations
at the Munger Canyon Mine was considered complete for the purposes of filing. The revision was submitted by
Lodestaz Energy, Inc. All review and comment periods as provided in the Act and the Regulations initiate from
this date of filing.
This revision would allow for construction of a small (4.9 acre) coal mine waste disposal area, to handle waste
material from the operator's McClane Canyon Mine (Permit No. C-1980-004) located adjacent to the Munger
Canyon Permit area. The proposal includes plans for diversion ditches, a sediment pond, and re-located road
segment.
The underground coal mining operation is on land located approximately 18 miles north of Loma, Colorado. The
permit area is further described as follows:
Mine site: Portions of Sections 21, 27, 28, 29, 32, 33, and 34, T7S, R102W, 6th P.M, all in Garfield County.
-Portions of Sections 2 and 3, T8S, R102W, 6th P.M., all in Ga~eld County. The proposed disturbance associated
with this revision is located within the SW 1/4 Sec. 28, T7S, R102W, 6's P.M. (see enclosed location maps).
The revision disturbance azea is shown on USGS 7.5 minute Howazd Canyon Quadrangle Map.
The technical revision application would incorporate a small additional disturbance within big sagebrush and
pinyon juniper habitat adjacent to the existing access road, within the approved permit area, but would not
otherwise alter previously approved permit conditions or mitigation measures. Additional water use associated
with the revision would be minimal (faz less than the 100 ac. foot "threshold"), due to the small size of the disposal
site, and projection that less than 5000 cubic yazds of waste material would be disposed of at the site during the
upcoming 5 year permiYterm. For these reasons, oar initial assessment is that "the activities would not affect the
continued existence of endangered or threatened species or result in the destruction or adverse modification of
their critical habitats as determined under the Endangered Species Act of 1973...."
