Bentonite Pit -File No. 77-231 <br />After the departure of Mike Stanton from our employ, I have made an attempt to <br />resolve some of the unfinished problems upon which he was working. The <br />situation as concerned the succession of operators and the missing file for <br />the L.B.C. Bentonite Pit was one such item. I think I have satisfactorily <br />resolved this problem. <br />First of all, I located the permit file for this operation among some <br />materials separate from our main files. An examination of this file showed <br />that although the Mined Land Reclamation Board had approved the permit <br />application for this operation on March 28, 1979, the First Land Company of <br />Howard had never submitted financial warranty, and thus, no permit for the <br />operation had ever tieen issued. <br />I discussed this situation with our Division Director and he said that, in his <br />opinion, our Division has received a document transferring the right to <br />receive a permit to your company, and we have also received the proper <br />financial and performance warranties. Therefore, he felt that a permit for <br />this operation should be issued to you as of the effective date of the Board's <br />approval of the succession from the First Land Company of Howard to your <br />company. <br />Thus, enclosed pease find a copy of the signed succession of operators form <br />(the original to remain in our file), and two signed copies of the mining and <br />reclamation permit for the L.B.C. Bentonite Pit, issued as of August 23, <br />1984. Please sign each copy in the space indicated, having your signature <br />notarized in each case. Then, retain one permit copy for your files and <br />return the other to our Division offices within two weeks. <br />Please review this permit document carefully. The legal description is for an <br />eight-acre operation at the description given in the orginal application and <br />clarified during adequacy correspondence between the original applicant and <br />our Division staff. All of the original application materials, as well as the <br />subsequent adequacy submittals, are considered an integral part of your permit <br />and are incorporated by reference.
