Long <br /> Division DireUOr <br />DATE: January 19, 1993 <br />TO: Mike Long <br />FROM: Steve Shuey ~~ <br />RE: Cyprus Orchard Valley Mine, File C-81-038, Extension of Abatement Time <br />for NOV C-92-035 <br />1 have attached a request for abatement time extension submitted by Cyprus Orchard <br />Valley Coal Corporation (COVCC). <br />I concur with COVCC that from the time they received the NOV, to the time set for <br />completion of abatement requirements they did not have an adequate "window of <br />opportunity" due to weather conditions, to clean the coal fines off the topsoil storage area <br />without causing detriment to the topsoil. I recommend the abatement time extension be <br />granted pursuant to Rule 5.03.2(2)(cl(iv) to allow the fill outslope significant time to melt <br />off and dry before final clean up procedures are initiated. <br />cc: file <br />m:\oss\yjb\abatement <br />
