Comment: Please inform the Division the types of hazardous chemicaLs/products <br />that will be stored on site, and how the surface water and groundwater <br />r systems will be protected from adverse impacts. <br />Response: WMI currently stores fuel and lubricants at the existing Lyons plant site <br />as part of its ongoing Lyons operation (Roclcin' WP Permit M 74-015). <br />The proposed amendment to this permit will not result in the storage of <br />any additional materials beyond the existing Lyons operation's area. The <br />Company employs a number of best management practices (BMP) such <br />as secondary containment in order to protect surface and groundwater <br />from contamination. WMI also has a storm water management plan for <br />this site issued by the Colorado Department of Health. <br />' ~7. Comment: Based on recent conversations with the applicant, Preble's Meadow <br />Jumping Mouse has been trapped within the permit area of the Lyons Pit <br />Amendment azea. Please inform the Division the status of the Preble's <br />study, and what issues have been discussed between the applicant and <br />the U.S. Fish & Wildlife Service. Please be aware that the applicant is <br />1 required to follow all County, State and Federal Laws regarding <br />threatened or endangered species. <br />' Response: Company representatives have met with the U.S. Fish and Wildlife <br />Service in order to discuss the status of the Preble's Meadow Jumping <br />Mouse at Lyons. The Company will develop a habitat conservation plan <br />in order to protect the mouse and to comply with the Endangered <br />Species Act. <br />1 ~38. Comment: The apphcant identified wetlands on the exhibits submitted to the <br />Division. Please be awaze that wetlands cannot be disturbed until the <br />Department of the Army, Corps of Engineers issues a permit. Please <br />commit in writing that no wetlands will be disturbed until the <br />Department issues the appropriate permit. <br />Response: Company representatives have met with the U.S. Army Corps of <br />` Engineers regarding wetlands and Section 404 compliance at the Lyons <br />site. <br />y 39.
