Lnng <br />Division Director <br />3/31/95 Issued during OSM-AFO oversite, for failure to minimize erosion as <br />necessary to protect topsoil, vegetation, and the hydrologic balance. <br />Disturbed area runoff was concentrated by a pit ramp road, concentrated <br />flow ran across undisturbed area. Resulting gully through undisturbed area <br />measured 5 feet deep, 2 feet wide, sediment delta deposited in 006 Gulch <br />(upchannel from Pond 006) appears to have been as large as 5 x 15 feet <br />and 10 inches deep. <br />4/7/95 Modified to include additional sections of Act, Rules, and permit violated. <br />5/1/95 Seneca Coal submits written argument stating TR is unnecessary and <br />redundant since abatement will not alter existing permit conditions. <br />5/4/95 Civil Penalty Assessed $1000.00. <br />5/4/95 DMG responds to 5/1/95 letter, DMG states TR is required. Abatement <br />deadline for submittal of TR extended to 5/19/95. <br />5/19/95 Request for assessment conference received, request dated 5/16/95. <br />5/22/95 Abatement deadline for TR submittal extended to 6/9/95. <br />6/6/95 Assessment Conference. <br />Description of the current, modified, extended version of NOV C-95-006 follows. <br />
