Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice .Your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Complete the following corrective agtion: <br />a.) Submit an interim bond amount of 5118,533.00 to the Division no <br />later than 5 P.H. on April 26, 1996. <br />b). Obtain a processed and approved amendment to the permit which <br />includes revised mining and reclamation plans and maps which <br />increase the maximum allowable pit size and provide plane for <br />reclaiming all areas disturbed by the mining operation, including <br />the pits and settling ponds, by no later than 5 P.M. on July 23, <br />1996. <br />e). The Division of Minerals and Geology and the operator will <br />continue to negotiate thr revised bond amount. <br />4. The Colorado Mined Land Board also orders that the matter of a civil <br />penalty will be continued to the July 24-25, 1996 Board Hearing. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />In clarification of the rights of recipients of Notices of violation, cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed ae a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, ae amended. <br />Dated at Denver this`~~~ day of ~~.~ ,~Z~. <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATDRAL RESOURCES <br />MICHAEL B.
