Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division has completed its preliminary review ofthe SL-3 bond release application. We have the <br />following comments. <br />1. Please submit the map referred to on page I of the bond release application as "Carbon Junction <br />Mine: Final Reclamation Phase I Bond Release Areas". [t was not included with the application. <br />2. Please submit a P.E: certified as-built design for the reconstructed Carbon Junction channel, <br />including the two new culverts. Please submit the design as a Minor Revision to the permit <br />application if the as-built is not significantly different from the original design, or as a Technical <br />Revision if the as-built is significantly different from the original design. <br />As noted in previous correspondence, the equipment in the storage yard will need to be removed <br />before the land where the equipment is located can be approved for Phase l bond release. Please <br />advise us of the schedule for removing the equipment. <br />4. Please advise us of the schedule for repairing the gully at the north end of North Pit. <br />5. Please advise us of the schedule for adding Flow dissipators (e.g., rock, silt fence, or shrubs) at the <br />inlet areas of the three rills on North Pit. <br />6. Now that the North Pit has been backfilled and graded, it would be appropriate to re-evaluate the <br />designs for the planned lower sump and upper sump #2. Please contact us so that we may discuss <br />those designs. <br />After the preceding items are resolved, the dollar amount eligible for bond release in SL-3 can be <br />established. <br />Sincerely, <br />Tom Kaldenbach <br />cc: Daniel 1.
