Four Comers Materials has received two recent letters from the Division of Minerals and Geology
regazding the Reclamation Bond (Financial Warranty -Corporate Surety) for the operation
described above. The first letter, with your signature upon it, was dated May 9th, and it arrived here
on the 10`s or l la`. The document refers to a mistake included in the replacement bond we provided
in October 2005: the permit number was listed incorrectly. The original bond was returned to us
`with`your letter:' Immediately upon receiving it, I corrected the first page of the bond with the
appropriate permit number, and deposited it back in the mail, addressed to your office.
Today (May 15d'), a new letter from the DMG arrived at our office. This document is dated May 8"',
and bears the signature of Mr. Cattany, the Division Director. According to this second letter, a
Formal Public Hearing will be held during the June 14-15, 2006 MLRB meeting for consideration of
the "violation," i.e., the DMG not having received a financial warranty to replace the warranty which
was cancelled on November 21, 2005.
I agree with the Division's assertion that the permit number designated on the warranty submitted in
October was incorrect. Please accept my sincere apology for any confusion this error may have
caused. However, I hope you will understand that the company's full intent was to maintain the
financial warranty in good standing, and.that the. error was purely accidental.
In `light of the fact that correction was made as soon as we became aware of our mistake, we
respectfully request that this item be removed from the agenda for the June 14-15 meeting of the
Mined Land Reclamation Boazd. If there is anything else that you require, iri order to satisfy
