Renner <br />z <br />granted by the Office of Surface Mining Reclamation and Enforcement <br />(OSM) on receipt of the information by your office as provided in <br />INE-35, 3.e.(i)(ii). <br />AFO recognizes that there is some merit in MLRD's comments regarding the <br />clarity of the TDN and what is addressed, Hopefully, that will be <br />corrected through the AFO minesite inspection report for this inspection <br />which has been prepared and distributed for your information. As to <br />evidence needed for the violation, AFO would comment that the OSM <br />inspector was accompanied on the minesite by MI.RD. According to <br />Mr. Fritz of this office, duplicate photographs were taken by your staff <br />of the section of road that is allegedly in violation during the onsite <br />review. Photographs, as well as the on-the-ground review, are <br />sufficient for the purpose of evidence for this violation. In addition, <br />the 10-day extension is granted.
