Permit Renewal Application No. 4 (RN-4)
Deaz Sir or Madam:
The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118,
Paragraph 3, of the Colorado Revised Statutes, that on June 3, 2005, an application to renew an existing permit to
conduct coal mining operations at the Seneca II-W Mine was considered complete for the purposes of filing. All
review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate
from this date of filing.
Seneca Coal Company proposes to continue surface coal mining and/or reclamation operations on land located
approximately 9 miles south of Hayden, Colorado. The permit area is further described as follows:
TSN, R88W; All of Section 15; Portions of Sections 9, 10, 11, 14, 16, 21, 22, 23, 26, 27, 34, and 35
T6N, R88W; Portions of Sections 14, 23 and 24
T6N, R87W; Portions of Sections 17, 18, 19
The above-mentioned tracts of land aze shown on USGS 7.5 minute Quadrangle maps of Hayden Gulch, Hayden,
Dunckley, Mt. Harris.
This permit renewal application would allow for renewal of Permit C-1982-057 for a new five year permit term,
which would extend to December 31, 2010. The application does not propose any expansion of approved permit
boundaries or surface disturbance acreage, nor does it propose any changes to approved mining or reclamation
plans.
In order for us to approve this renewal, we are required to make a fmding that "the activities would not affect the
continued existence of endangered or threatened species or result in the destruction or adverse modification of
their critical habitats as determined under the Endangered Species Act of 1973...." We request your review and
recommendation pursuant to this fmding. Applicable sections of the renewal application are enclosed. Please
advise us if you require additional information.
In order for us to comply with regulatory time frames, we request that comments be submitted to the Division of
Minerals and Geology at the above address by on August 2, 2005. If no comments are received by this date, we
