Cattany <br />Fish and Wildlife Enhancement Division Director <br />U.S. Fish and Wildlife Service Natural Resource Trustee <br />764 Horizon Drive, South Annex A <br />Grand Junction, CO 81506-3904 <br />Re: Seneca II-W Mine (Permit No. C-1982-OS'~ <br />Permit Renewal Application No. 4 (RN-4) <br />Deaz Sir or Madam: <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118, <br />Paragraph 3, of the Colorado Revised Statutes, that on June 3, 2005, an application to renew an existing permit to <br />conduct coal mining operations at the Seneca II-W Mine was considered complete for the purposes of filing. All <br />review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate <br />from this date of filing. <br />Seneca Coal Company proposes to continue surface coal mining and/or reclamation operations on land located <br />approximately 9 miles south of Hayden, Colorado. The permit area is further described as follows: <br />TSN, R88W; All of Section 15; Portions of Sections 9, 10, 11, 14, 16, 21, 22, 23, 26, 27, 34, and 35 <br />T6N, R88W; Portions of Sections 14, 23 and 24 <br />T6N, R87W; Portions of Sections 17, 18, 19 <br />The above-mentioned tracts of land aze shown on USGS 7.5 minute Quadrangle maps of Hayden Gulch, Hayden, <br />Dunckley, Mt. Harris. <br />This permit renewal application would allow for renewal of Permit C-1982-057 for a new five year permit term, <br />which would extend to December 31, 2010. The application does not propose any expansion of approved permit <br />boundaries or surface disturbance acreage, nor does it propose any changes to approved mining or reclamation <br />plans. <br />In order for us to approve this renewal, we are required to make a fmding that "the activities would not affect the <br />continued existence of endangered or threatened species or result in the destruction or adverse modification of <br />their critical habitats as determined under the Endangered Species Act of 1973...." We request your review and <br />recommendation pursuant to this fmding. Applicable sections of the renewal application are enclosed. Please <br />advise us if you require additional information. <br />In order for us to comply with regulatory time frames, we request that comments be submitted to the Division of <br />Minerals and Geology at the above address by on August 2, 2005.
