Mr. Dan Mathemr <br />Diui.riori of Minerak and Geohgy <br />Page 2 <br />There is another situation that could potentially affect the timing and SCC's ability to maintain the <br />schedule fox contemporaneous xeclamation......T'he UMWA labor contract eapites September 1, <br />2005. There is a potential for a work stoppage, however, the past two (2) UMWA contracts have <br />been successfully ratified without interruption to the operation. In SCC's case the UMWA members <br />at Peabody Western's Arizona operations outnumber the SCC union members and will probably <br />have the controlliag votes in the decision.
