I . Pertinent statutory citations :
34-32-!16 (7) (g) - Disturbances to the prevailing hydrologic balance
of the affected land and of the surrounding area. . . shall be
minimized.
34-32-116 (2) - Reclamation plans shall be based upon provisions
for, or satisfactory explanation of, all general requirements for
the type of reclamation chosen. The details of the plan shall be
appropriate to the type of reclamation designated by the
operator. . .
34 -32-116 (7) (b) - Reclamation plans and the implementation thereof
shall conform to the following general requirements: Earth dams
shall be constructed, if necessary to impound water, if the
formation of such impoundments will not . . .damage adjoining
property.

In floodplains where a regulatory floodway has not been designated,
Federal Insurance Administration (FIA) minimum regulations require
that no development be permitted within the one percent annual
chance floodplain that would - individually or cumulatively with
other anticipated development - increase that water surface
elevation of the base flood by more than one foot .
The regulations provide for mapping areas behind levees as
protected from the one percent annual chance flood only if the
levee system provides protection from that flood, as determined
through application of FEMA-established design criteria for
freeboard, closures, embankment protection, embankment and
