reclamation activities. at the mined site. <br />CORRECTIVE ACTIONS <br />Require the operator and/or landowner to secure an approved Construction Material (110) <br />Extraction permit by September 27, 1999 or a Construction Material (112) Extraction permit <br />by January 24, 2000. <br />Require the operator and/or landowner to post an interim reclamation bond in the amount of <br />$5,000.00 by August 27, 1999. <br />3. <br />4. <br />CIVIL PENALTY (C.R.S. 34-32.5-123) <br />Require the operator and/or landowner to pay a minimum civil penalty in the amount of <br />$ 568.95 ,based on 15 hours of staff time at $37.93/hour. <br />2. If the Board finds the operation to be an illegal Construction Material Extraction Operation, <br />the Board should also assess the operator and/or landowner a civil penalty of not less than <br />$1,000.00 per day nor more than $5,000.00 per day for each day the land has been affected, <br />not to exceed 365 days. <br />a. In this case, the Office recommends that the Board find 41 days of violation <br />at $ 1,000.00 per day. <br />b. The total civil penalty of $ 41,568.95 (Nos. 1 & 2) is due 30 days from the <br />date of the signed Board Order. <br />c. The Office recommends that $ 40,000.00 of the total civil penalty be <br />suspended, if corrective actions are completed by the above noted corrective <br />action dates and the interim bond is posted by August 27, 1999. <br />If the Board finds the operation to be an illegal Construction Material Exploration Operation, <br />the Board should also assess the operator and/or landowner a civil penalty of not less than <br />$50.00 per day nor more than $200.00 per day for each day the land has been affected, not to <br />exceed 60 days. <br />a.
