Box 42 <br />Gunnison, Colorado 81230 <br />RE: Dickerson Pit (Permit M-78-305) Reason to Believe Violations Exist <br />Dear Mr. Wilcox: <br />On March 11, 1992, we conducted an inspection of your mine and found: <br />evidence of the implementation and/or existence of mining and reclamation plans <br />that do not conform those currently approved for the Dickerson Pit. <br />We believe these are in violation of: Sections 34-32-110(2)la1(VII) and (IX), <br />Section 34-32-110 17)(c- and by reference, Sections 34-32-11612) and <br />34-32-112(3- and (41 together with Section 34-32-124 (6) of the Colorado Mined <br />Land Reclamation Act 34-32-101 et. sec., C.R.S. 1973 as amended. <br />Therefore, we have found reason to believe violations exist to Permit M-78-305 <br />and the Law and have scheduled this matter before the Mined Land Reclamation <br />Board. <br />A Formal Public Hearing will be held during the August 26-27, 1992 Board meeting <br />for consideration of possible violation. The hearing will be held in Room 318 of <br />1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or as soon <br />thereafter as the matter can be considered and you will have the opportunity to be <br />represented and heard. It will be reiterated that there is reason to believe that you <br />are in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a cease and desist order, <br />assess a civil penalty in the amount of 550.00 to 5200.00 each day of violation or <br />order the permit be suspended, modified or revoked. If you have evidence <br />indicating that the possible violations noted above do not exist or have been <br />corrected, please provide it to us as soon as possible or bring it to the hearing. <br /> <br />
