Roberts, County Engineer
Montrose County
P.O. Box 1289
Montrose, CO 81402
~~
DEPARTMENT OF
NATURAL
RESOURCES
Roy Romer
Governor
lames S. Lochhead
E~ecuuve Director
Michael B. Long
Division Director
RE: Neal Pit (Permit-83-148) County response, dated September 3,
1996, to Division's adequacy review of conversion application
Deatr Mr. Roberts:
I have reviewed the above referenced response and can, with one
exception, accept it as satisfying the adequacy concerns indicated
to you in my review letter of June 18, 1996. The remaining adequacy
concern is the absence of an acceptable seed mix to be used in
revegetating the site. If you can provide a seed mix, acceptable
to the Division, by the decision date of September 24, 1996, I can
approve the application without conditions, providing all other
issues (listed below) are satisfactorily addressed. If you cannot
provide an acceptable seed mix by that date, I will approve the
application with a condition that such a seed mix, acceptable to
the Division, be provided prior to the commencement of reclamation
at the site.
There are two other issues that must be addressed by the decision
date in order for the Division to approve the conversion
application for the Neal Pit. These are as follows:
1) As indicated to you in Ms. Lavern Lemay's letter of April
9, 1996, it is the practice of the Division to require proof
of receipt of notices sent in the form of the signed and
postal date-stanped green Certified Mail cards. You have
supplied copies of those cards; the Division would like to
have the cards themselves.
2) The response did not include evidence that the corrections
to the initial conversion application, which now make that
application approvable, were added to the copy of the
conversion a~~plication on file at the County Clerk and
Recorder's Office. Please supply such evidence, ie. a signed
and dated receipt from the Clerk and Recorder's Office, that
the material included in the County's adequacy response were
added to the original copy of the application.
