(Pit <br />No. 1~ Route 1, Box 78, Littleton, CO 80125 <br />Dear Sir: <br />As you know, the United States Army Corps of Engineers has <br />regulatory jurisdiction over waters of the United States which <br />include adjacent and isolated wetlands, pursuant to the provisions <br />of Section 404 of the Clean Water Act (33 USC 1344). Under this <br />Act, prior authorization is required from the U.S. Army Corps <br />of Engineers for the discharge of dredged fill or fill material <br />riverward of the ordinary high water mark of waters of the United <br />States and into the Wetlands. This Regulatory jurisdiction is <br />administered under Federal Regulation 33 CFR 320-330. <br />If the proposed activity includes the discharge of dredged <br />fill or fill material--permanent or temporary--riverward of the <br />ordinary high water mark of any waters of the United States or <br />wetlands, please advise Bradley Sand and Gravel to contact this <br />office. <br />If you have any questions, please contact the Colorado <br />Regulatory Program Field Representative at the Platte River Resident <br />Office in Littleton, Colorado.
