At the December National TIPS Steering Committee meeting, I sat <br />through a prolonged discussion of this same problem. It recently hecame <br />apparent i:o the OSMRE, that a coal mine operator in Ohio had possession <br />software copied from a TIPS work station. This particular operator submi ted <br />a coal permit application con tainfng SEDCAD analyses, still bearing the 0 MRf_ <br />TIPS inscription on the bottom of each page. Apparently the state in whi h <br />this occurred had been handing out copies of TIPS software at industry re ue:ct. <br />It shouldn't take a mental giant to realize that such practices are illeg 1, <br />whether they involve federal software or private software. The softwara <br />manufacturer's license agreements prohibit sharing of software without <br />individual purchase. The OSMRE letter informs the Division that any such <br />distributirtn of software is illegal and will result in the OSMRE withdrawing <br />the TIPS ecuipment from any offending State regulatory program. <br />Most of the TIPS software is private and licensed only for use on the TIPS <br />workstation. Some of the TIPS software is "site licensed" (SB-Slope only). <br />As such it can be copied to other computers which reside within our office. <br />Some of the software is "public domain" (HC-GRAM, Blast, Storm, TA PP & TR- 5) <br />and can be freely distributed.
