<br />Natural hazard lands <br />Identify areas of unstable geology; state "The mining and <br />reclamation operations will not substantially endanger life and <br />property because of the effects of mining and reclamation operations <br />on the areas of unstable geology"; and state why. <br />(CR) <br />State "There are no areas of unstable geology in the permit and <br />adjacent areas." <br />(AND) <br />Identify areas subject to frequent flooding; state "The mining and <br />reclamation operations will not substantially endanger Life and <br />property because of the effects of mining and reclamation operations <br />on the areas subject to frequent flooding"; and state why. <br />(OR) <br />State "there are no areas subject to frequent flooding in the permit <br />and adjacent areas." <br />OSMRE will review the PAP and will review the State RA's analysis of <br />unsuitability pursuant to section 522(a)(3) of SMCRA. As a result <br />of this reviex and again assuming concurrence with the State RA's <br />analysis, OSMRE can make the finding that the Federsl lands within <br />the permit area are not unsuitable for mining in accordance with <br />section 522(b) of SMCRA pursuant to section 522(b) of SMCRA. <br />The Foidel Creek mine is located within the drainage basin of the Upper <br />Colorado River, as defined by the U.S. Fish and 'dildlife Service (FWS). <br />All projects requiring Federal approval in the Upper Colorado River Basin <br />must take part in the FWS's Windy Gap process. This process is an <br />evaluation of the cumulative effects of depletions on endangered species <br />of fish in the basin.
