<br />The Division of Reclamation, Mining and Safety (Division), in accordance with Title 34, Article 33, Section 116,
<br />Paragraph 4, of the Colorado Revised Statutes, considered an application to revise coal mining operations at the
<br />Foidel Creek Mine complete for the purposes of filing as of August 21, 2006. The revisiolt was submitted by
<br />Twentymile Coal Company. All review and comment periods as provided in the Act and the Regulations initiate
<br />from this date of filing.
<br />The underground coal mining operation is on land located approximately 23 miles Southwest of Steamboat
<br />Springs, Colorado. The permit area is further described as in portions of Sections 7, 8, 9, T4W, R86W; Sections 32
<br />and 33, T6N, R86W; Sections 23, 24, 25, 26, 27, 34, 35 and 36 in TSN, R87W; and all of TSN, R86W with the
<br />exception of Sections 34, 35, and 36. These tracts of land are shown on USGS 7.5 minute Quadrangle map of
<br />Rattlesnake Butte, Cow Creek, Dunckley, Milner, Mount Harris, and Oak Creek.
<br />This Minor Revision proposes the construction of a million gallon water tank, on the surface, in support of
<br />underground mining operations. The tank is filled from underground supply lines. Sources of water are both
<br />surface and underground. An overflow from the tank is a part of the design. The Division has advised the applicant
<br />that a discharge from this overflow lilte would be a point discharge, and that an appropriate discharge permit
<br />would be required.
