Rules 4.09 and 4.10: <br />la) 4.09.112): Please provide the modified refuse pile designs that have been certified by <br />a registered professional engineer. <br />(b) 4.09.1(1 1) and 4.10.2(11: Please commit that inspections of the fill will be conducted <br />by a registered engineer, or other qualified professional specialist, experienced in <br />construction of earth and rockfill embankments" at least quarterly throughout the <br />construction and (emphasis added) during the following critical construction periods: <br />(1) removal of all organic material and topsoil, (2) placement of underdrainage <br />systems, 13) installation of surface drainage systems, (4) placement and compaction <br />of fill materials, and.l5) revegetation." <br />Please also commit that "the qualified registered engineer shall provide to the Division <br />a certified report within two weeks after each inspections that the fill has been <br />constructed as specified in the designs approved by the Division" (see Item 22(a) in <br />this letter). <br />Ica Please discuss whether the areas where the coal mine waste bank is proposed for <br />construction contain springs, natural or man-made watercourses, or wet-weather <br />seeps. If so, please provide designs for an underdrain system in accordance with <br />Rules 4.09.11131, 4.09.2(2), and 4.10.3(1). <br />(d) ~ Please provide the foundation investigation and laboratory testing of foundation <br />materials, if not already provided, for any new areas upon which the modified refuse <br />pile will be constructed, pursuant to Rule 4.09.1(14). The analysis of foundation <br />conditions is required to include the effect of underground workings, if any, upon the <br />stability of the structure. <br />23. Rule 4.1 1.4: Please commit to complying with this rule regarding disposal of non-coal <br />waste. <br />24. Rule 4.14.2: Please discuss whether construction of the refuse pile will include <br />construction of any cut-and-fill terraces as described in Rule 4.14.2(21 or small depressions <br />as described in Rule 4.14,2(31. <br />25. Rule 4.14.2(5): Please discuss what methods will be used to reduce slippage of backfilled <br />materials. <br />26. Rule 4.15.5: Please discuss how livestock grazing will be prevented during the first year <br />following reseeding, and during the time in which revegetation success sampling will <br />occur. <br />27. Rule 4.30.2(2): Please discuss what surface equipment and facilities currently exist at the <br />site that are not currently proposed for permanent retention. Please describe how and <br />when these items will be removed. <br />
