Consider Staff recommendation on bond <br />forfeiture. Monthly status update (continued from the July Board <br />Meeting). <br />Two inspections of this site have been conducted since the July Board <br />Meeting. Staff stated that the reclamation of this site is being <br />conducted according to the approved schedule. <br />The company has requested reduction of a portion of the bond, based on <br />the amount of work completed to this point. The Division has scheduled <br />a bond inspection for the first week of September. <br />Staff Presentation by John Doerfer: <br />DISCUSSION ITEM <br />inera u e-ma ing. <br />Consideration and adoption of changes to existing rules and regulations <br />of the Colorado Mined Land Reclamation Act. Article 32 of Title 34, <br />C.R.S. The rule-making is proposed pursuant to the authority granted <br />under 34-32-108, C.R.S. Rules to be considered include those continued <br />from the June 27, 1990 hearing as published in the Colorado Register on <br />April 10, 1990, and rules identified in the notice pu6T'isTe3-in~Fie- <br />Colorado Register on July 10, 1990. <br />The Director provided updated information regarding the rule-making <br />meetings. The Assistant Attorney General, as well as some Board <br />members have attended some of these meetings. <br />At this time, the Division is not prepared to present the Board with a <br />rule-making package and recommend action. The Director stated that the <br />Division would request that the Board grant a continuance of the <br />rule-making to the September Board Meeting. At that time, the Division <br />would conduct a full discussion of the details of this issue. There <br />are same rules upon which same disagreement may remain. The Division <br />would take time to isolate those disagreements so that a clear set of <br />issues could be presented to the Board at the September Board Meeting. <br />The Division recommended that the Board continue rule-making. <br />Mr. Frank Johnson, Assistant Attorney General, discussed briefly the <br />major being considered at the informal conferences: issues of 1) the <br />new process the Division is recommending for approval of 112 permit <br />applications, including delegation of decision authority to the <br />Division and 2) conferring. <br />
