STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: Battle Mountain Resources, Inc. ) NOTICE OF VIOLATION M-95-043 <br />P.O. Box 310 ) AND <br />San Luis, CO 81152-0310 ) BOARD ORDER <br />TO: Battle Mountain Resources, Inc. and all other persons engaged in or owning or controlling the following <br />operation: San Luis Project, Permit No. M-88-112. <br />FINDINGS OF FACT <br />Pursuant to the audrority vested in the Stale of Colorado Mined Land Reclamation Board by C.R.$. 34-32-124, the <br />Board hereby makes the following findings of fact: <br />Battle Mountain Resources, Inc. is permitted to conduct a mining operation under the (terms of Permit <br />M-88-112 located in Section 22, Township 32 South, Range 71 West of the 6th P.M., in ICostilla County, <br />Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on May 25, )(995 [o consider <br />possible violation of the terms of Permit M-88-112 and C.R.S. 34-32-LOI et sec .. <br />3. The Division of Minerals and Geology presented evidence at the Formal Public Hearing od May 25, 1995, <br />demonstrating that <br />Battle Mountain Resottrces, Inc. failed to submit quarterly and/or bi-weekly water sampling <br />reports for the permitted water monitoring stations, or process stations, as requi by the terms <br />and conditions of the approved permit. Specifically, bi-weekly water sampling epotts were not <br />submitted for the period from December I, 1993 to June 18, 1994. Quarterly piing reports <br />were not submitted in January, 1994 and April, 1994. <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with C.R.S. 34-32-124(6), the Colorado Mined Land <br />Reclamation Board hereby finds Battle Mountain Resources, Inc. to be in violation of Permit M-88-~ 12, specifically <br />C.R.S. 34-32-124. <br />BOARD ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in accordance with C.R.S. 3A-32-124(2),(6) <br />and (7) We Colorado Mined land Reclamation Board hereby orders Battle Mountain Resources, Ibc. to: <br />1. Complete the following corrective action: <br />Provide to the Board by Juae 15, 1995 evidence of changes in internal procedures'phat will assure <br />against a recurrence of the problem. <br />
