In four separate orders, the Board assessed civil penalties, issued a cease <br />and desist order preventing further mining activities outside of the permitted boundaries and <br />ordered the Operator to undertake corrective actions within 180 days of the signed Board <br />orders. The Board orders were signed on January 21, 2005, which gave the Operator until <br />July 20, 2005 to comply. <br />3. The Operator requested, and received, an extension to obtain a Section 112 reclamation <br />permit by November 17, 2005. <br />4. The Operator now seeks an extension to September 30, 2005 to complete the temporary <br />sediment control plan. <br />5. Based on the Division's recommendation and the Operator's appazent intent to comply with <br />the Board's corrective actions, it is appropriate to extend the deadline for completion of the <br />temporary sediment control plan to September 30, 2005. <br />6. It is appropriate to condition such an extension on the understanding that the Operator shall <br />comply with all other Boazd-ordered corrective actions in a timely manner, as set forth in <br />prior Board orders concerning this site. <br />
