hearing. The Operator posted a reclamation bond in the amount of $282,000.00. The
Operator completed a temporary sediment control plan and reclaimed a road cut outside of
the permit boundaries.
8. The Operator now requests reinstatement of its suspended permit and reconsideration of the
$10,000.00 in civil penalties still unpaid. The Operator testified that he was unaware that an
additional $10,000.00 in civil penalties was owed and that money used to pay the
outstanding civil penalty could be better used in reclamation activities.
ORDER
Based on the foregoing findings of fact and conclusions of law, the Board hereby suspends the
Operator's obligation to pay the $10,000.00 civil penalty. The Board retains the authority to
reimpose the $10,000.00 civil penalty if the Operator fails to comply with the Act in the future.
The Board hereby determines that the Operator's permit is in compliance and, therefore, the
Boazd rescinds its suspension of the Operator's permit. The Operator's permit is therefore
reinstated.
r/~
DATED this ~ day of ~ L -/ , 2007.
FOR THE COLORADO MINED LAND RECLAMATION BOARD
-~~-- ~. '
Michael T.
