The <br />Operator completed a temporary sediment control plan and reclaimed a road cut outside of <br />the permit boundaries. <br />8. The Operator now requests reinstatement of its suspended permit and reconsideration of the <br />$10,000.00 in civil penalties still unpaid. The Operator testified that he was unaware that an <br />additional $10,000.00 in civil penalties was owed and that money used to pay the <br />outstanding civil penalty could be better used in reclamation activities. <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board hereby suspends the <br />Operator's obligation to pay the $10,000.00 civil penalty. The Board retains the authority to <br />reimpose the $10,000.00 civil penalty if the Operator fails to comply with the Act in the future. <br />The Board hereby determines that the Operator's permit is in compliance and, therefore, the <br />Boazd rescinds its suspension of the Operator's permit.
