Specifically, sediment eroding from <br />the temporary overburden stockpile washed over approx 1 5 acres of undisturbed land <br />resulting in contamination of undisturbed topsoil <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />ACT SECTION(S) 34-33-120(2)(d), 34-33-120(2)(.i)(II), 34-33-120(2)(x) <br />REGULATION SECTION(S) 4.14.1(2)(b), 4.05.5(2)(c), 4.18(1) <br />PERMIT SECTION(S) <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br />Area located between topsoil stockpile E-1 and sediment pond A and south of <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br />A diversion ditch must be placed to carry runoff from the south side of the over- <br />burden stockpile to sediment pond A. The previously undisturbed area must have the <br />deposited toxic material removed. A plan for reclamation must be submitted <br />including sampling of the underlying topsoil in 6 inch increments to determine its <br />present suitability as a growing medium. Their results can be compared to <br />previous baseline. <br />
