(xiii) This item was the same item described herein as Item No. I.n.(v). This item was <br />discussed in general terms in correspondence to the Division from Raton Wesf dated <br />February 22, 1994, and in more specific terms in correspondence to the Division from <br />Raton West dated April 5, 1994. <br />_• - - o. In a-letter dated May_5, 199,theDixision_itrfortued_Raton West-drat-the-Division-had, as- - -- <br />part of the review of Raton West's comments, developed three additional stipulations to the <br />Division's January 1994 proposed decision. These were to have been presented to the Board <br />at the April 1994 meeting, for the Board's consideration of the Division's request that they <br />be made part of the permit. In submittals from Basin received by the Division subsequent <br />to May 5, 1994 and prior to the May Board Meeting, Basin incorporated the language from <br />these previously proposed stipulations into its permit document. These proposed stipulations <br />were: <br />(i) Basin shall update the Surface Ownership Map for those areas in which undermining <br />is anticipated during the permit term. Submittal to the Division of the updated map <br />shall occur on or before July 31, October 31, January 31, and April 30, yearly; <br />(ii) Basin will maintain on file at the mine site proof of mailing of the public notices <br />required pursuant to Rule 4.20.2; <br />(iii) If the extracted material thickness from the longwall mining operation exceeds nine <br />vertical feet, Basin will provide as part of its semi-annual subsidence monitoring <br />report, information indicating any significant resultant differences in the surface area <br />predicted to be subject to subsidence. The Structures Inventory Map (Map No. 16) <br />will be updated as necessary to reflect any such changes. <br />p. The Division, in further consideration of Raton West's concerns and in cooperation with <br />Basin Resources, developed a new stipulation that should be added to the Division's January <br />1994 proposed decision to renew the Golden Eagle Mine permit. This new Stipulation <br />No. 72 reads: <br />(i) Basin Resources will conduct on a quarterly basis an on-the-ground survey for the <br />existence of structures in (I) the areas anticipated to be undermined in the ensuing <br />three months, (2) the areas anticipated to be affected by the resultant subsidence, and <br />(3) the 500 foot buffer zone beyond the areas anticipated to be affected by the <br />subsidence. <br />q. The Division, also in further consideration of Raton West's concerns, developed a modifica- <br />tion in the language of the Division's January 1994 proposed decision document. The <br />Division requested the Board consider revising the sentence in Stipulation 67 that reads: <br />The Division's review of the probable hydrologic consequences of the proposed mining <br />operation has determined that impacts to the overall hydrologic regime... <br />The Division requested the revised sentence to read: <br />The Division's review of the probable hydrologic consequences ojthe proposed mining <br />operations has determined that long-term adverse impacts to the overall hydrologic <br />regime... <br />4 <br />
