RN-02, BASIN RESOURCES, INC., THE GOLDEN EAGLE MINE, PERMIT NO. C-81-013. <br />RATON WEST-BALDWIN, LTD., <br />Petitioner <br />This matter comes before We Board pursuant to a request by Raton West-Baldwin Ltd. (Raton <br />West) for a formal public bearing concerning Permit Renewal No. RN-02 for the Golden Pagle Mine <br />permit, Permit No. C-81-013. The Board hereby upholds the Division's modified proposed decision <br />to approve, with one stipulation, Pennit Renewal No. RN-02. <br />EVIDENCE AND TESTIMONY <br />The Division presented evidence and/or testimony thaC <br />a. On April 19, 1993, the Division notified Basin Resources of Basin's requirement to submit <br />to the Division by June 29, 1993 an application for renewal of the Golden Eagle Mine permit. <br />This notification was provided to the operator pursuant to Section 2.08.5(2)(a) of the Board's <br />Regulations. <br />b. On August 31, 1993, the Division notified Basin that the Division had not received the appli- <br />cation for renewal by that date and, as such, if the permit for the Golden Eagle Mine were <br />not renewed by January 25, 1994, mining activities at the mine would have to be curtailed <br />until the permit was renewed. <br />c. During the period from September 1, 1993 to September 7, 1993, Basin submitted its renewal <br />application materials. On September 7, 1993, the Division deemed the renewal application <br />complete. <br />d. During the period from September 1993 through January 1994, the Division conducted its <br />adequacy review of the renewal application. <br />e. During the month of January 1994, it became evident to Basin that the Golden Eagle permit <br />would expire before a final decision regarding its renewal could occur. On January 18, 1994, <br />the Division received a request for a formal public hearing from Basin, to allow Basin the <br />opportunity to request from the Board temporary relief under Section 2.07.4(3)(d) from <br />having to curtail its mining activities during the period between permit expiration and <br />renewal. <br />
