CC&V understands that all <br />remaining technical adequacy items have, as of our discussions on November 20, 1998, been <br />presented to CC&V and, based on the Office of Mined Land Reclamation's ("OMLR") review <br />of this concluding response by CC&V, will have been adequately clarified or stated by CC&V <br />so as to be acceptable elements of the application for Amendment No. 7. <br />As agreed, CC&V is submitting this letter to memorialize the agreed-upon responses and to <br />assist the OMLR in completing i[s findings in preparation for its decision scheduled for <br />November 30, 1998. The following statements are provided in the approximate order they were <br />discussed on November 20, 1998. <br />Ten-foot distance from toe of ore to liner ed1=e: CC&V submitted responses of October 25 and <br />November 12, 1998 to the OMLR's requests regarding stability of the ore outslopes on the <br />valley leach facility which were, first, to assess the potential for ore to move outside the lined <br />area of the valley leach facility (which potential was found to be very low), and subsequently <br />to specify the distance maintained between the toe of the outslope of the placed ore and edge of <br />the liner. To further elucidate on its prior responses, CC&V has agreed to limit this distance <br />to a minimum of 10 feet, except where ingress and egress is required or where the distance is, <br />on the date of this letter, less than 10 feet, until such time as CC&V has demonstrated, through <br />an inventory of the amount of ravelling observed, if any, at the toe of existing angle of repose <br />slopes of design height, that the distance from the toe to the liner edge is not critical to retaining <br />ravelling ore because, for example, there was minimal ravelling observed after placement.
