Cattany <br />Acting Division Director <br />Re: Letters of Concern, Conversion Application (CN-O1), Circle 23 Pit, M-1978-192 <br />Dear Mr. Nelson: <br />Enclosed are copies of letters of concern from Ruth Moore, Joyce Simon and Alice Sawyer <br />regazding your conversion application. <br />It is not cleaz if these citizens are objecting to the application or if they are just concerned about <br />the operation. In order to become a party the obiectinn submission must comply with the <br />following deadline, pursuant to requirements of Rule 1.7.1(2), "in the case of a 112 Reclamation <br />Permit Application, such written comments, protests, and petitions for a hearing must be <br />received by the Office not more than twenty (20) calendaz days after the last date for the <br />newspaper publication of notice..." Cheri said the last day of publication was November 7, 2002 <br />so the submissions should have been received by 4:00 PM on November 27, 2002, and should <br />have said they are objecting to the application if they wanted to become parties. As noted, Ms. <br />Moore's letter was received on November 29, 2002, Ms. Simon's letter was received on <br />November 30, 2002 and Ms. Sawyei s letter was received on December 2, 2002. All of the <br />letters were received after the comment period expired so they will not be considered objecting <br />parties (besides, they did not say they were objecting to the application). <br />In addition, other than the septic system sludge item, the items of concern do not fall under the <br />jurisdiction of the DMG. Property devaluation, noise, hours of operation etc. are county issues. <br />The DMG will send a letter to the concerned citizens informing them of the jurisdictional <br />situation. <br />If you respond to the concerned parties please send copies of your correspondence to the <br />Division. <br />If you have any questions, please give me a call. <br />
