RULE 9: Criteria for approval or denial of all reclamation permits
9. 1
® BASIS b PURPOSE
Criteria for approval or denial of all reclamation permits: during the
original promulgation of rules, the Board attempted to keep all provisions
applicable to its consideration of an application in each rule so that
an applicant would not need to search throughout all of the rules to find
all of the requirerrents for submission of an application. While reviewing
the rules, the Board determined that several provisions originally required
to be submitted as part of an application should be considered separately
from the items required to be submitted as part of an application. By
this restructuring the application items are restricted to the Items directly
connected with the mining and reclamation activities. The items encom-
passed in RULE 9 are merely reorganized from other parts of the original
regulations. RULE 9 clarifies that these three items are legally required
to be presented to the Board to enable it to act upon an application.
The procedure to be followed by the Board in determining whether or not
to grant a permit. Tn this manner, an applicant should be able to clearly
understand the requirements of an application and the law.
- 57 -
