RULE 9: Criteria for approval or denial of all reclamation permits <br /> 9. 1 <br /> ® BASIS b PURPOSE <br /> Criteria for approval or denial of all reclamation permits: during the <br /> original promulgation of rules, the Board attempted to keep all provisions <br /> applicable to its consideration of an application in each rule so that <br /> an applicant would not need to search throughout all of the rules to find <br /> all of the requirerrents for submission of an application. While reviewing <br /> the rules, the Board determined that several provisions originally required <br /> to be submitted as part of an application should be considered separately <br /> from the items required to be submitted as part of an application. By <br /> this restructuring the application items are restricted to the Items directly <br /> connected with the mining and reclamation activities. The items encom- <br /> passed in RULE 9 are merely reorganized from other parts of the original <br /> regulations. RULE 9 clarifies that these three items are legally required <br /> to be presented to the Board to enable it to act upon an application. <br /> The procedure to be followed by the Board in determining whether or not <br /> to grant a permit. Tn this manner, an applicant should be able to clearly <br /> understand the requirements of an application and the law. <br /> - 57 - <br />
