110(I) (14) "Limited impt operation" applies to any minOg operation which: <br /> (a) affects less than ten acres and <br /> (b) extracts less than 70,000 tons of mineral , overburden , or combination <br /> thereof per calendar year. <br /> See RULE 3 in these Rules and Regulations. <br /> (15) "Meeting", as the term is used in these regulations means a hearing held <br /> under the provisions of C.R.S . 1973, 24-4-104. Topics to be considered at <br /> such hearings include, but are not limited to: <br /> (a) requests for approval , conversion, or amendment of permits ; <br /> (b) increases , reductions , or full or partial releases of surety; <br /> (c) requests for or issuance of cease and desist orders ; <br /> (d) consideration of whether or not good cause has been shown to <br /> schedule a hearing; <br /> (e) amendment of Rules and Regulations. <br /> 103(7) (16) "Mineral" means an inanimate constituent of the earth in a solid, liquid, <br /> or gaseous state which, when extracted from the earth, is useable in its <br /> natural form or is capable of conversion into a useable form as a metal , a <br /> metallic compound, a chemical , an energy source , or a raw material for <br /> manufacturing or construction material . For the purposes of this article, <br /> this definition does not include surface or subsurface water, geothermal <br /> resources , or natural oil and gas together with other chemicals recovered <br /> therewith, but does include oil shale. <br /> 103(8) (17) "Mining operation" means the development or extraction of a mineral from <br /> its natural occurrences on affected land. The term includes , but is not <br /> limited to, open mining and surface operations and the disposal of refuse <br /> ® from underground and in situ mining. The term includes the following opera- <br /> tions on affected lands : transportation , concentrating, milling, evapora- <br /> tion, and other processing. The term does not include: the exploration and <br /> extraction of natural petroleum in a liquid or gaseous state by means of <br /> wells or pipe; the extraction of geothermal resources ; smelting, refining, <br /> cleaning, preparation, transportation, and other off-site operations not <br /> conducted on affected land. <br /> 103(9) (18) "Open mining" means the mining of minerals by removing the overburden <br /> lying above such deposits and mining directly from the deposits thereby <br /> exposed. The term includes mining directly from such deposits where there <br /> is no overburden. The term includes, but is not limited to, such practices <br /> as open cut mining, open pit minino, strip mininq, quarrying, and dredging. <br /> 1030 0) (19) "Operator" means any person , firm, partnership, association or corporation <br /> or any department , division , or agency of federal , state, county or muni- <br /> cipal government engaged in or controlling a mining operation. As used <br /> herein , operator shall also mean applicant for a permit. <br /> 1030 1 ) (20) "Overburden" means all of the earth and other materials which lie above <br /> natural minerals and also such earth and other materials disturbed from <br /> their natural state in the process of mining. <br /> - 3 - <br />
