'RULE S: PROSPECTING NOTIC•ND RECLAMATION REQUIREMENTS • <br /> 1130 ) 5. 1 Notice of Intent to Conduct Prospecting Operations <br /> Any person desiring to conduct prospecting shall , prior to entry <br /> upon the lands , file with the Board a Notice of Intent to Conduct <br /> Prospecting Operations on a form provided by the Board. <br /> 108(1 ) The Board will treat prospecting/mining on a case-by-case basis <br /> 103(4) if the Mined Land Reclamation staff is uncomfortable as to the validity <br /> 1030 2) of an activity under Notice of Intent to Conduct Prospecting. <br /> 113 This Board considers the term "exploration' to have the same meaning <br /> as the term "prospecting" within the Act and "development ," as defined <br /> in the Act, is a mining operation. <br /> 5• I1 Such notice form shall contain the following : <br /> (1 ) Date of filing of the Notice of Intent , <br /> 113(2) (a) (2) Prospector - Name , address , and phone number of person <br /> or organization doing the prospecting, <br /> (3) Contact - name , address , and phone number of person in the <br /> organization who should be contacted concerning reclama- <br /> tion, <br /> (4) Description of lands, including : <br /> a. Site name, if applicable, <br /> 1113(2) (d) b. Location , by township and range ( if more than one <br /> township is involved, give the one which includes <br /> most of the affected land) , <br /> C. Estimated acreage of land surface to be disturbed , <br /> 113(2) (e) (5) Date of commencement - approximate date of anticipated <br /> commencement of the above-described prospecting activity, <br /> 113(2) (c) (6) Type of operation - describe the type of operations which <br /> will be undertaken in conducting the prospecting operations. <br /> For example: "The prospecting operations will involve <br /> drilling, trenching, bulk sample removal , shaft sinking, <br /> etc.", or "The drilling will be conducted by use of a <br /> truck mounted rig , mud drilling, air drilling, etc.", <br /> 113(2) (f) (7) Reclamation Measures - state the measures to be taken to <br /> reclaim any affected land consistent with the applicable <br /> requirements of RULE 6, and <br /> 113(2) (b) (8) A statement that prospecting will be conducted pursuant to <br /> the terms and conditions listed on the approved form. <br /> 113(3) 5.2 Confidentiality <br /> All information provided the Board in a Notice of Intent to Conduct <br /> Propsecting shall be protected as confidential information by the <br /> Board and not be a matter of public record in the absence of a written <br /> release from the operator or upon a finding by the Board that <br /> reclamation is satisfactory, whichever may first occur. <br /> - 32 - <br />
