2.37 If t , Board establishes a hearing onRe issues raised by such
petitions , it shall :
( 1) Prior to the holding of any such hearing , give notice of
the date, time , and place of the hearing to:
10 a) The operator: and
b) Any person filing objections to, protests against ,
petitions for hearing, or statements in support, by mail ;
and
c) The public, by mailing list . newspaper release, and
posting as prescribed in Section 1 .26( 1 ) .
(2) Publish twice, once a week for two consecutive weeks
prior to such hearing, notice of its date , time and place
in a newspaper of general circulation in the locality of
the proposed mining operation.
2.38 A hearing on such protests shall be held in conformance with
• the requirements of Section 8.24. At such hearing, the Board
will consider all relevant evidence.
1160) (a) 2.41 Annual Reports
2.41 On the anniversary date of each permit year, the operator shall
submit a report and map (to a scale of not less than 100' to
the inch and not more than 660' to the inch) , indicating the phases
of the reclamation plan which have been completed , correlated
with the timetable. The report and map shall contain the fol-
lowing information:
( 1 ) Location and number of acres affected during that year,
(2) Locations and number of acres reclaimed for that year,
(3) The location and number of acres in the various stages of
reclamation (backfilled , graded , topsoil replaced , reveg-
etated) ,
(4) The species of vegetation planted , the locations and
approximate dates of planting,
(5) The type and approximate quantity of fertilizers , organic
material or soil conditioners used and location of use ,
(6) An appraisal of the success of reclamation efforts , and in
the event of failure of any efforts , a short narrative on
the suspected or determined caused of such failure,
(7) Estimates of the location and number of acres to be
affected in the coming year, and
(8) The effective date of the information provided above shall
be no more than 45 days prior to the anniversary date.
2.42 In addition to the plan and map, an annual fee of S350.00, if
the operation is an open mininn operation , or 5275.00 for any
other operation must be submitted.
