1 . 3 Public Inspection of Documents
1 . 31 Except as provided in Section 1 . 33 , all applications , public notices,
inspection reports , documents , maps , exhibits , correspondence , tests ,
analyses , records of actions or findings of the Board or its represen-
tatives and other information required under this law or these Rules shall
be promptly made available for inspection to any member of the public at
the offices of the Division , during its normal business hours .
1 .32 Upon request , copies shall be provided at cost or other suitable arrange-
ments made for copying at the requestor's expense , as allowed by copy-
right law.
112(9) 1 .33 An operator may mark "CONFIDENTIAL" information supplied in a permit
application disclosing the location. size , or nature of the deposit or
depth and thickness of the ore body or deposit and thickness and type
of overburden to be removed.
(1 ) Confidential information so marked shall not be available to the
public until the mining operation is terminated , unless the operator
gives a written consent to the release of all or any part of the
information.
(2) All information in a Notice of Intent to Conduct Prospectinq shall
be treated as confidential . Such information shall not be available
to the public until a finding by the Board that reclamation is satis-
factory, unless the operator gives a written consent to the release
of all or any part of the information. (Anyone who willfully and
knowingly violates the provisions of confidentiality shall be
punished as provided by law.)
1 .4 Conflict of Interest
1 .41 No Board member of Division employee shall participate in any transaction
or any part of the decision-making process respectinn a permit , prospecting
notice, or enforcement action under the Act , if he or any member of his
immediate family has a financial interest in the outcome of a Board
decision , except as authorized by the Board after full disclosure by the
affected board or staff member.
1 .5 Permit Granting and Denial
I1 1 .51 Board action granting or denyina permits shall be made only at a public
meeting or at a public hearina.
1 . 52 After the filino of an application , the Board shall :
115(2) ( 1) In the case of a renular permit , meet to consider the permit
application within 90 days , at which time it shall approve , deny
or, for a good cause shown, set a public hearina date. If a
public hearing date is set , the hearing shall be held and the permit
application shall be granted or denied within 120 days of filing.
In the event of serious unforeseen circumstances or significant
snow cover on the affected land that prevents a necessary on-site
01 inspection the time may be extended to a maximum of 180 days ;
