1 . 3 Public Inspection of Documents <br /> 1 . 31 Except as provided in Section 1 . 33 , all applications , public notices, <br /> inspection reports , documents , maps , exhibits , correspondence , tests , <br /> analyses , records of actions or findings of the Board or its represen- <br /> tatives and other information required under this law or these Rules shall <br /> be promptly made available for inspection to any member of the public at <br /> the offices of the Division , during its normal business hours . <br /> 1 .32 Upon request , copies shall be provided at cost or other suitable arrange- <br /> ments made for copying at the requestor's expense , as allowed by copy- <br /> right law. <br /> 112(9) 1 .33 An operator may mark "CONFIDENTIAL" information supplied in a permit <br /> application disclosing the location. size , or nature of the deposit or <br /> depth and thickness of the ore body or deposit and thickness and type <br /> of overburden to be removed. <br /> (1 ) Confidential information so marked shall not be available to the <br /> public until the mining operation is terminated , unless the operator <br /> gives a written consent to the release of all or any part of the <br /> information. <br /> (2) All information in a Notice of Intent to Conduct Prospectinq shall <br /> be treated as confidential . Such information shall not be available <br /> to the public until a finding by the Board that reclamation is satis- <br /> factory, unless the operator gives a written consent to the release <br /> of all or any part of the information. (Anyone who willfully and <br /> knowingly violates the provisions of confidentiality shall be <br /> punished as provided by law.) <br /> 1 .4 Conflict of Interest <br /> 1 .41 No Board member of Division employee shall participate in any transaction <br /> or any part of the decision-making process respectinn a permit , prospecting <br /> notice, or enforcement action under the Act , if he or any member of his <br /> immediate family has a financial interest in the outcome of a Board <br /> decision , except as authorized by the Board after full disclosure by the <br /> affected board or staff member. <br /> 1 .5 Permit Granting and Denial <br /> I1 1 .51 Board action granting or denyina permits shall be made only at a public <br /> meeting or at a public hearina. <br /> 1 . 52 After the filino of an application , the Board shall : <br /> 115(2) ( 1) In the case of a renular permit , meet to consider the permit <br /> application within 90 days , at which time it shall approve , deny <br /> or, for a good cause shown, set a public hearina date. If a <br /> public hearing date is set , the hearing shall be held and the permit <br /> application shall be granted or denied within 120 days of filing. <br /> In the event of serious unforeseen circumstances or significant <br /> snow cover on the affected land that prevents a necessary on-site <br /> 01 inspection the time may be extended to a maximum of 180 days ; <br /> 7 <br />
