OSM is in agreement with [he proposed decision and hereby provides concurrence to <br />the Phase II and Phase III bond release in accordance with Article VIII of the State-Federal <br />Cooperative Agreement codified at 30 CFR 906.30.24. <br />DMG, with OSM's participation, conducted the required Phase II and Phase III bond release <br />inspection. The Proposed Decision documents the inspection findings. Public notice and <br />landowner notifications were made as required. Lands subject to the bond release include both <br />Federal surface and coal. The United States Department of the Interior, Bureau of Land <br />Management (BLM) was notified of the inspection and has been provided copies of the bond <br />release application and DMG's proposed decision as the Federal land management agency. <br />BLM issued a letter of concurrence dated April 21, 1998, agreeing with DMG's Proposed <br />Decision to grant final bond release. <br />Please address any questions regarding this action to Ron Sassaman at 303-844-1521. <br />Sincerely, <br />Ron Sassaman James F.
