A damage agreement is being developed at this time for these poles. 2 The Ouray ditch -The ditch will not be disturbed until damage agreements are in place for the relocation of the ditch and agreement with the Ouray Ditch Company has been received. 3 The US Hwy 550 passes to the west of the property. It is the owners belief that no damage will result to the structure as a result of mining. Notification to CDOT has been made. Ditch tt2 will not require a damage agreement for relocation across the permitted property. However continuous and uninterrupted flow must be available during irrigation season in like quantity and quality as the adjacent downstream user is accustomed. The point of delivery to the adjacent landowner cannot be moved without a written agreement with this user. • As witnessed by this application and signature below: Ouray County (operator and property owner), hereby takes responsibility for all damages arising to all structures (those owned by others and those owned by Ouray County) that occur directly or indirectly as a result of mining activities at this site. The fences on the affected area are convenience fences and are in good condition. These fence lines are to remain in good condition throughout the permit life. The fences a! trvvned by the land owner /applicant and as such shall be their sole responsibility for maintaining the integrity of the fence lines.
