~~

Letter to Joseph de Raismes 11 Mav 3, 1995
It is the Division's view that the "reasonable Wray" that the
operator can undertake and complete satisfactory reclamation at the
site is to systematically go forward with the elcements of the
approved reclamation plan, assess the degree of success or failure
in the revegetation effort that results, and implement corrective
measures as necessary. This process is well underway with the
implementation of the current reclamation initiative that resulted
from the compliance program specified by the Division. Varra
Companies has demonstrated a willingness and an ability to bring the
site into compliance with the approved permit, ,ind has been
cooperative in meeting the deadlines established by the Division.
The Division believes that essentially all of the concerns .Listed in your
letter dated April 21, 1995 are unfounded when reviewed ins terms of the
Colorado Mined Land Reclamation Act. Hopefully, the c:Tarifications
provided here will help to assuage some of the City of Boulder's
trepidation regarding the outcome of reclamation at the Jenkins Site.
Please be assured that the Division is keenly aware of the City of
Boulder's deep abiding interests in the future of its public open space,
and we would like to work with the City and the operator t.o assure that
the minimum requirements of the Mine Land Reclamation Act are achieved at
the site.
If you have any questions, please contact me.
Sincerely,
C ~~/~~
Allen C.
