~~ <br /> <br />Letter to Joseph de Raismes 11 Mav 3, 1995 <br />It is the Division's view that the "reasonable Wray" that the <br />operator can undertake and complete satisfactory reclamation at the <br />site is to systematically go forward with the elcements of the <br />approved reclamation plan, assess the degree of success or failure <br />in the revegetation effort that results, and implement corrective <br />measures as necessary. This process is well underway with the <br />implementation of the current reclamation initiative that resulted <br />from the compliance program specified by the Division. Varra <br />Companies has demonstrated a willingness and an ability to bring the <br />site into compliance with the approved permit, ,ind has been <br />cooperative in meeting the deadlines established by the Division. <br />The Division believes that essentially all of the concerns .Listed in your <br />letter dated April 21, 1995 are unfounded when reviewed ins terms of the <br />Colorado Mined Land Reclamation Act. Hopefully, the c:Tarifications <br />provided here will help to assuage some of the City of Boulder's <br />trepidation regarding the outcome of reclamation at the Jenkins Site. <br />Please be assured that the Division is keenly aware of the City of <br />Boulder's deep abiding interests in the future of its public open space, <br />and we would like to work with the City and the operator t.o assure that <br />the minimum requirements of the Mine Land Reclamation Act are achieved at <br />the site. <br />If you have any questions, please contact me. <br />Sincerely, <br />C ~~/~~ <br />Allen C.
