The <br />regulations indicate that civil penalty assessments where a greater degree of fault than negligence <br />is encountered shall consider whether the violation results from actions which are reckless, <br />knowing, or intentional (Rule 5.04.5(3)(c)(iii)). Based on the discussion of events leading to this <br />violation in the Division's July 15, 1997 inspection report, I am assessing $1250 for fault for a <br />violation resulting from actions which were known to be in violation of regulatory requirements <br />for obtaining approval of operation plans prior to implementation. <br />GOOD FAITH <br />There is no evidence in the file of extraordinary efforts made to abate this violation. No credit <br />for good faith is awazded at this time. <br />
