The <br />last time that any rode was removed from our pit was ]anuary of 1997. We are requesting this intermittent status. <br />because rode is not taken out on any regulaz schedule, but rather only if some constnrction is taking place in the <br />near vicinity of our pit. At such times of activity. a construction representative will approach us and we will strike <br />up a deal. Therefore, we caild be extracting rode at any time, but do not have any definite timetable at this point <br />in time. At this time. no reclamation has taken place due to the size of the disturbance. Apprordma[ely, .8 acre <br />has been disturbed. The area is small enough that one can not reclaim any of the acreage, because it is all being <br />used at the present when mining occurs. We have placed a sign at the entrance to our pit and mazked the <br />perimeter so that it is easily distinguishable. The current financial warranty is adequate since the area will be <br />made into a feedlot upon the completion of mining. The slopes will be graded and seeded at that time. The costs <br />of replacing topsoil and seeding trove remained fairly constant over the years and should not need to be adjusted. <br />Rule 1.13.7 addresses the requirement of notifying the Boazd each yeaz via [he annual report of the status of <br />mining during the year, which we can do in our report. <br />Your prompt attention to this matter is greatly appreciated. <br />Sin/ce~ely, <br />Harold Brandstadt <br />
