. .: <br />-z- <br />In correspondence subsequent to these letters, received by the Division on <br />July 23, 1984, Mr. Ronald S. Hamagami, the registered professional engineer <br />for Yampa Mining Company states that "The intent of my original certification <br />on the road classification map [Exhibit I] was to substantiate that the road <br />had been built as designed in accordance with Section 4.03." Mr. Hamagami <br />further states in the letter that he recertifies the haul road to be built as <br />constructed and in compliance with Rule 4.03. <br />Notice of Violation C-64-137 has been abated, and it is now my feeling that it <br />is up to the Division Director, an assessment conference officer, or the Board <br />to determine whether the certification present in the exhibits constituted <br />satisfaction of the requirements of Rule 4.03.1(1)(d).
