The document: <br />A) Established Permi[ Conditions for points of compliance within the permit area. <br />B) Established reporting requirements for: <br />a) Sending water quality analyses results to the Division. <br />b) Specific time limit to report exceedances of the permit condition values. <br />C) Outlines specific responses by BMRI if an exceedance occurs at any point of compliance. <br />• Dl Defines procedures BMRI must follow if exceedances of a pernit condition value (or <br />values) occurs in three. (3) consecutive water samples. BMRI will submit [o the Dlvision, within <br />30-days of the receipt of [he final verification sample analysis, a specific response plan, including <br />a schedule for the implementation of the plan. <br />2. BMRI notified the Division un July 28, 1998 that TDS levels in the M-1 l R pelnt of <br />compliance exceeded the approved permit condition value of 613 ppm. The measured <br />concentration of TDS in the July 8, 1998 water sample was 661 ppm. As required, BMRI <br />collected the first verification sample on August IU, 1998. Lab results were received un August <br />11, 1998. TDS measured 772 ppm which still exceeded the permit condition value. A second <br />verification sample was collected on August 20, 1998. TDS measured 696 ppni in this sample <br />which still exceeded permit conditions. <br />3. On August 31, 1998, the Division notified BMRI of the requirements of TR-I5. Specifically, <br />submittal of the required response plan. BMRI submitted the Response Plan on September 24, <br />1998. However, due to changing conditions at [he site, changes not anticipated in the initial <br />response plan, BMRI revised the Response Plan and submitted a new Plan on November 16, <br />1998. The new Response plan has been fully implemented. <br />4. On December 1, 1998, the Division sent BMRI a Reason to Believe letter citing n possible <br />violation of permit conditions for groundwater. The letter was re-issued on December 16, 1998. <br />• 5. BMRI appeared before the Board at the January 26, 1999 meeting. The Board did not find a <br />
