Alpine Rock Swan River Resource, M-1993-035 <br />Response to April 16, 2007, DRMS Letter <br />3 August 2007 <br />Page 4 <br />reclamation that would make removal of the dredge piles overly burdensome or <br />cost prohibitive. No specific soil amendment is required by the stipulation, and <br />the stipulation's purposes are served at this juncture by securing plant growth <br />medium from off-site sources. <br />Summit County is actively seeking sources of topsoil to place on the property. <br />While no specific action has been required by the Division at this time (and the <br />M-1993-035 permit should provide flexibility to amend soils from on-site, as well <br />as off-site, sources -noting that on-site sources were mentioned in the Division's <br />letter of April 16), Summit County has prospects for local topsoil and aspires to <br />import this material in the near future. Topsoil import from a local resource would <br />be a reclamation measure consistent with current objectives. A Rule 3.1.9(5) <br />notice is submitted concurrently and effectively resolves questions about how <br />plant growth medium will be sufficient for reclamation. <br />Based on the progress recently made to resolve issues identified by the DRMS <br />concerning M-1993-035, the operator does not wish to process a temporary <br />cessation as originally suggested. That suggested course of action would <br />specifically prevent Summit County from taking action to promote reclamation on <br />the site, for example, with a short current window of opportunity to utilize topsoil <br />from a nearby construction site on Muggins' Gulch (immediately to the north of <br />M-1993-035). Given the benefit of such opportunities to the long-term <br />reclamation of the site, the operator prefers to diligently work toward resolution of <br />issues in the manner discussed above, keeping the DRMS apprised of progress <br />in the upcoming months. <br />Please contact Banks and Gesso, LLC, with any questions related to this letter or <br />the request for Technical Revision to M-1993-035.
