The <br />Division alleges that sediment control at a waste pile under construction at <br />Mountain Coal Company's West Elk Mine was ineffective, and further alleges <br />that Mountain Coal Company had contaminated topsoil at this site. Mountain <br />Coal Company disputes these allegations and therefore requests that the Board <br />formally review NOV C-95-016. <br />Mountain Coal Company and the Division will participate in an assessment <br />conference concerning this NOV.
