Box 591 <br />Somerset, Colorado 81434 <br />Re: Minor Revision No. 208 (Request for Minor Revision to Improve Hydrologic <br />Monitoring Program); West Elk Mine (Permit No. C-80-007) <br />Dear Ms. Johnston: <br />On February 18, 1997, the Division received the above-referenced minor revision application. <br />The application has been deemed incomplete for the purposes of filing. The Division has also <br />reviewed Mountain Coal Company's (MCC's) February 10, 1997 letter which responds to our <br />original request for a minor revision application (Division letter dated December 9, 1996). On <br />December 5, 1997 the Division received MCC's responses to our incompleteness letter via <br />facsimile. Based on our review of your responses and your February 10, 1997 submittal, the <br />Division has the following remaining adequacy concerns. The comments numbered below <br />correspond to the same numbered paragraphs contained in our February 27, 1997 incompleteness <br />letter. <br />1. With the exception of the following minor comment, this response is accepted. The text <br />submitted on revised page 2.05-80 states that if the inflows continuous, an initial sample <br />will be obtained and then sampled at least annually thereafter. Revised Table 5 shows <br />under the Water Quality column that Mine Inflows will be sampled 3 times per year. To <br />be consistent with the revised text, this entry in Table 5 should read annually. Please <br />consider this and if appropriate, submit a revised Table 5. <br />2. Response accepted. However, please note that information submittal requirements <br />regarding sumping and underground water routing practices at the West Elk Mine are <br />currently being reviewed with Technical Revision 1I80 application package. No additional <br />response is needed for this minor revision. <br />3. No response required. <br />
