• <br />Date: Sept 21, <br />File No.: M84-155 <br />Operator: Dolores <br />Location: Dolores <br /> <br />~_ <br />PERMITTED 110(2) OPERATION <br />PRESENTATION FORM <br />1994 Commodity: <br />Acreage: <br />County Specialist: <br />County Existing Bond: <br />Gravel <br />9.6 acres <br />Bob Oswald <br />n/a <br />At the June 1994 Board meeting, the operator was found to be in <br />violation of CRS 34-32 109, for mining without a permit (extent of <br />area is approx 30 acres). <br />The Board wished to review the matter at the August 1994 Board <br />meeting, to review the operator's progress toward completion of the <br />Board-ordered corrective actions, and to discuss a civil penalty. <br />(Due to a staff oversight, this was not put on the August agenda.) <br />The corrective actions were to be: <br />Operator will apply for a conversion of the 110 permit to a <br />112 permit, application to be received by the Division by <br />August 21, 1994, and approved within 120 days of submittal. <br />The operator submitted said 112 application, before the date stated <br />in the NOV. <br />The Notice of Violation indicated that the Board may consider at <br />this hearing a proposal from the operator to reclaim prelaw, <br />unreclaimed pits, in lieu of assessing a civil penalty. The <br />operator has submitted several letters pro Q-~o~eclaim, and <br />also for reclamation actually undertaken see attached . <br />Based on the approved schedule of civil penalties for unpermitted <br />mining of this extent, the total may range up to $60,000. <br />b:\dmgcorr9.94 <br />~dnlvi ~ kGCC.~~ 1./Ir~ ~•V<.
