At the June 1994 Board meeting, the operator was found to be in
violation of CRS 34-32 109, for mining without a permit (extent of
area is approx 30 acres).
The Board wished to review the matter at the August 1994 Board
meeting, to review the operator's progress toward completion of the
Board-ordered corrective actions, and to discuss a civil penalty.
(Due to a staff oversight, this was not put on the August agenda.)
The corrective actions were to be:
Operator will apply for a conversion of the 110 permit to a
112 permit, application to be received by the Division by
August 21, 1994, and approved within 120 days of submittal.
The operator submitted said 112 application, before the date stated
in the NOV.
The Notice of Violation indicated that the Board may consider at
this hearing a proposal from the operator to reclaim prelaw,
unreclaimed pits, in lieu of assessing a civil penalty. The
operator has submitted several letters pro Q-~o~eclaim, and
also for reclamation actually undertaken see attached .
Based on the approved schedule of civil penalties for unpermitted
mining of this extent, the total may range up to $60,000.
