This includes but is not limited to; 88ih <br />Avenue (can be combined with Legal Right of Entry ,4greement noted above), two gas lines, <br />other overhead and underground utilities, and ground water wells (addressed in Technical <br />Revision 003). <br />The applicant has provided the Division with copies of [he utility locate forms for the high- <br />pressure gas line and overhead and buried utility lines. These agreements again need to be tied <br />back to the operator. Please see options noted in January 19, 2001 letter from Cheryl Linden of <br />the Attorney General's Office. <br />In addition, to ensure that the gas pipeline structures will be protected during construction the <br />operator will need to confirm in writing that the conditions of the agreements will be followed. <br />Specifically, a representative of the gas line utility must be present when work is to occur in the <br />vicinity of the gas lines. <br />Rule 6.4.12 Reclamation Costs <br />The applicant provided a cost estimate for reclamation of the pipeline facility. The estimate <br />totals $950,000.00. The estimate is determined on the amount it would cost the State of <br />Colorado to perform the work in accordance with the approved postmining land use. In order to <br />minimize the required financial warranty, the operator may commit to an alternate reclamation <br />plan. The alternate reclamation could be a statement in the permit stating that the slurry wall will <br />be sealed if the operator or City of Thornton does not install the pipeline structures. This would <br />eliminate the need for the Division to construct the various pipelines and facilities associated <br />with the plan, and therefore reduce the required amount of financial warranty. <br />To commit to the alternate reclamation plan would reduce the bond amount to $198,000.00. See <br />the DMG estimate for further detail. Please note that this amount also includes reclamation of <br />the open cut road. If boring under the road is to take place, the bond can be further reduced. <br />The end of the public comment period is February 22, 2001. This is the earliest date in which the <br />Division can issue a proposed decision. Please respond to the above mentioned concerns prior to this <br />date.
