(1989 Sup p.) and Permit No. M-77-205 require you to submit 5350.00 in annual fees and an annual report on or before November 29 of each year. As of the date of this letter we-1a not received your annual fees and report. Therefore, you are in violation of the above cited statute and the provisions of your Permit No. M-77-205. Pursuant to Section 34-32-124(7), C.R.S. (19841 you are hereby assessed a civil penalty in the amount of 5350.00. If you fail to submit your annual fees, annual report and the civil penalties assessed to our office by January 2, 1991, this matter will be scheduled for Formal Public Hearing before the Mined Land Reclamation Board for consideration of permit revocation and forfeiture of your 59,100.00 Letter of Credit No. 12 at the January Board Meeting.
